Contractors, subcontractors and suppliers of materials to a construction project all have lien rights. Lien protection also extends to suppliers to suppliers, as well as design professionals, soil testers, mappers, and parties providing demolition or excavation services.
To ensure full lien protection, a lien claimant must file a mechanics lien within 90 days after the last date of furnishing labor or materials to the project. If the 90-day deadline is not met, the lien claim will not be valid against the property owner to the extent that the owner has paid the GC prior to the filing of the lien. If you do delay filing your lien claim, note that it must be filed within 3 years from the date of the first furnishing of labor or materials.
