Title 25, Chapter 61 of the Delaware Constitution provides that if the landlord purchases utility services for a building and redistributes the services to its various tenants, it can collect the costs of those services from the tenants at the same rate that they would be billed by the public utility if it billed them directly.
Chapter 61 also provides that any property taxes paid by the tenant shall be set off against the rent for the commercial space. If the rent is not sufficient to pay off the entire amount, the tenant can demand repayment from the landlord.
